Was just sent a message that a Baffin guide was ticketed for having 4 customers on boat and not maintaining 6' distancing. Was reported on Capt Mickey's radio show.

The guide should have told his customers to refer to him (or her) as "Reverend Captain", and claim they were at a church service.

6' spacing with 4 passengers + 1 captain = 30 foot boat. Not gonna find one of those in Baffin. I still agree with the premise though - absolutely ridiculous. If you can stay an arm span away from each person, that's right at 6 ft. Pretty sure you can do that on most guide boats.

Maybe thinking non-linear. 3 on each side, with an 8 ft beam (width) boat.

Net person needs a 9ft handle on the net!

Still, on an 18' boat with 5 people you could position 4 people starboard and port more than arm's length apart, 2 on the bow and 2 on the stern, with the captain in the middle seat and be just fine. Sounds like a bogus case of law abuse to me.

What we really need is distance from the big city folks. If you study the Covid map for the US, all the big hotspots have international airports! Hmmmmm.
Most local cases began with travel from elsewhere.

The Captain had specific rules to follow in order to keep his business afloat, and he didn't follow them. I don't see the problem.

Agreed. What 'law enforcement' ticketed this Captain exactly, and what were the specific charges? Not keeping arm's length apart? Kleberg isn't a mask-requiring county so it can't be that. I'd like to know the details too because this sounds like BS to me. Either a fake report or something that can be easily fought in court.

I believe an attorney would tell you that, like a speeding ticket, this is a liability rather than a crime.
As in the case of most speeding tickets, there's not a contest that he had 4 people on the boat.
The argument, then, would be about the judgment of the LEO in giving the citation. Did this situation warrant a ticket, and the outcome is the judge's interpretation of the state order being violated, very likely including where did the people in the boat travel from.

(Would the LEO have cited him if it was the guide and just one or two other people on the boat?)

A similar situation was reported on TKF, a guy back from fishing was landing his boat on a private boat ramp, not far from home, and he was cited for violating the Stay at Home order.
So what you're fighting in court is how hungry are the county coffers, and what's your stature with the judge.

I suggest the officer might be subject to being charged with harassment of a fisherman or fishermen?
