No matter where you stand, consider this, someone could have been sitting on the rocks doing a little night fishing when Joe Schmoe came along (drunk or not) and I for one would rather the cops collected the evidence to convict the SOB if he had killed someone. I have fished those rocks with my kid. If it aint legal to do it, then like you said "( though it probably oughtta be)"

"what coulda been" does not count in court. Fact is really, speeding is not an arrestable offense. Neither is wrecking your own truck.

Now, I'm betting the game warden is busily putting together a pollution case that is going to hammer him a lot worse than any speeding ticket or DWI will. Wink

Woulda, coulda, shoulda doesn't work in court or with the cops, that's why you'd better be willing and able to protect yourself in ANY situation!

To me, the only ways that someone could legitimately claim that they didn't see the rocks would be; not looking ahead for long periods (for any reason), falling asleep, driving with the lights off or going so fast that none of these mattered........ Which would be darn fast!!! Shocked Being drunk, stoned or both is highly likely at this time of the morning as another poster said, and could easily account for any or all of the above. Yes, there's also the "can't fix stupid" factor, but the only other thing that comes to my mind would a seizure caused by a brain malfunction or a little behind the wheel hanky panky![/i]

Want to know something this opens up? Our hero can sue the city.

I don't recall any signs, barricades or reflectors on or before the jetty and the road runs right to the water's edge. Essentially, an unmarked traffic hazard.

Some bottom-feeding lawyer will EASILY go for that.

Jellyfish have no brain nor central nervous system, but employ a loose network of nerves, located in the epidermis, which is called a "nerve net".[17] A jellyfish detects various stimuli including the touch of other animals via this nerve net, which then transmits impulses both throughout the nerve net and around a circular nerve ring, through the rhopalial lappet, located at the rim of the jellyfish body, to other nerve cells.

Another counter to the "brainless jellyfish" hypothesis[clarification needed] is that some species explicitly adapt to tidal flux to control their location. In Roscoe Bay, jellyfish ride the current at ebb tide until they hit a gravel bar, and then descend below the current. They remain in still waters waiting for the tide to rise, ascending and allowing it to sweep them back into the bay. They monitor salinity to avoid fresh water from mountain snowmelt, again by diving until they find enough salt.[2]
