Cannot give a guy a field sobriety test when he's being treated in an ambulance.

Besides, I resent the implication. I wrecked three cars on the beach by the time I was 20, and I was cold sober for all of them.

From what i have heard from my local friends he was being was busy with a chick that was laying in his lap being real busy.

Back in the day I use to drive my 2wd jeep Cherokee down the PINS until I got stuck, that would be where I set up fish camp. Maybe that's what this guy was doing? Haha

That must be the new program I have been reading about in CCA's magazine.

I think it was called "Rednecks to Reefs" Just let the rednecks drive their trucks into the water and we will have a nice reef one day!

For those wondering, you cannot just throw a breath ( or blood) test at just anyone you feel like. You have to develop a case to do so. Further, blood tests are restricted more than breath. No one is going to go to the trouble and expense just because some clown trashed his own car.

If nubnuts is not exhibiting signs of intoxication that' s pretty much the end of it.

Keep in mind, breath or blood is collected as evidence AFTER you arrest. A lot like you would collect a burglar's tools or a rapist's clothes. The arrest is based on what you observe, not what you collect after you hook him up.

One last thing. Blood and breath is only really good for alcohol. If he's on something else and the collision does not involve serious bodily injury or death he's not going to be tested at all. ( cost mainly.)

Not getting into the legal end of this discussion but!!!

I think speeding down the beach in the wee hours and driving into the channel is clearly a sign of some form of impairment. Not to mention breaking a law or two.

And! back in 76, I was sitting on the beach (with a girl) around 11:pm when a speeding drunk rammed my car and then left the seen. He was caught by witnesses down the beach. My point, this clown could have just as easily ran over one of us as dumped his truck in the drink. I think you need a BOC test pretty quick or you loose that possible piece of evidence, right?

Now that I think about it, that was right about where Packery is now!

Nope." Signs of impairment" has a legal definition and driving like a jackass isn't in there. ( though it probably oughtta be)
