"Please be advised that the City Attorney has determined that your intent to circulate petitions regarding the Charter Amendment Election does not comply with the Referendum Proceedings in the City Charter. Article I Section 4 (b) states that "the power of initiative and referendum povided in this section shall not apply when another referendum procedure is available under this charter or State law".
Texas Local Government Code Section 9.004 expressly provides the procedure for petitioners to submit a proposed Charter Amendment.

"While your request for reconsideration of this matter will still be submitted to the Council during the April 11, 2006 City Council Meeting, be advised that I will not be providing your group with petition pages for circulation if the Council does not repeal the section of the Charter Election ordinance in question.

"Please inform the other signators of the City Attorney's determination.

You may already have seen this on the KRIS and KIII news, but here's what's happening. The City won't allow the BAC to delete just part of the proposed ordinance for the charter amendment through the referendum process, but is forcing us to compete by initiating our own charter amendment, instead. We'd need the same number of registered voter signatures for such an initiative as it will to get a referendum vote against the other ordinance calling for the 7400-foot beach closure. The upshot of that is we could, by taking our time in turning in the signatures, have it all decided at the April election. Actually, we're allowed 180 days to gather them for the initiative.

The City did us a favor, for, if the City Council won't reconsider and rescind the two ordinances tomorrow, we could have those stinko ordinances on the same ballot with our good amemndment. That would allow a direct comparison of the competing charter amendments by the voters, and force the City to defend the non-competitive and vague language in its version. Best of all, if the City tries that trick again of waiting to see if we'll get enough signatures before rescinding the ordinances, that won't affect the initiative for a clean and simple charter amendment. Resistance really IS futile! Razz
