Suit against wind power projects is rejected

A federal judge in Austin has dismissed a lawsuit filed by a group of coastal environmental associations seeking to block construction of two massive wind energy projects on the Kenedy Ranch.

While the written ruling from U.S. District Judge Lee Yeakel is not yet on file, the oral opinion will apparently clear away the last legal hurdle facing the controversial project's two foreign developers.

“The winds of South Texas are one of the largest and most attractive renewable energy resources in the country, representing a tremendous clean and never-ending power supply,” said John Calaway, chief development officer in North America for the Australian company, Babcock & Brown, in a Thursday news release.

Babcock & Brown is building an $800 million project on Kenedy Ranch land belonging to the John G. and Marie Stella Kenedy Memorial Foundation. PPM Energy, a division of the Spanish energy giant Iberdrola, is building a $400 million project on adjacent land owned by the John G. Kenedy Jr. Charitable Trust.

Together, if fully developed, the two projects will produce enough energy to power 180,000 homes.

Both projects will rely on hundreds of massive turbines reaching 400 feet in the air.

According to the Coastal Habitat Alliance, a loose alliance created to oppose the project, the turbines will cause massive bird deaths and desecrate the untouched coastal plain.

Among the members of the coalition are the King Ranch, the American Bird Conservancy and the Lower Laguna Madre Foundation.

In its federal suit, the group had argued that the federal Coastal Zone Management Act required Texas to conduct public hearings before the wind farms could be built. But Judge Yeakel disagreed.

The coalition, which earlier lost a suit in state court also trying to block the wind projects, is now left to ponder its legal options.

“We have not seen (Judge Yeakel's) written opinion at this time. Until we see the opinion, we cannot make a decision on an appeal,” wrote Coalition lawyer Jim Blackburn in a Thursday e-mail.

And while he said the lawsuits had focused public attention on the environmental threats facing this remote stretch of the Texas coast by massive developments, “For now, litigation is over.”

yes, change is on the horizon... literally.

But people need to realize you can't have it both ways. EVERYONE wants cheap energy, yet NO ONE wants to make the sacrifice of additional "things" in order to get it.

If the windmills go up here, they complain about bird deaths, if they go up in the desert, they complain about horny toad deaths....

for the life of me, I don't understand how a bird can't see a 100 foot long by 5 foot wide blade going about .004 MPH. birds of prey can see a mouse fart from 500 feet in the air, and they can't see a windmill?

The best part about it, is the projections made on the "potential".

Anyone who wants to have the "not in my back yard" attitude need only look to California for a perfect and scary example of what that will bring. Remember the energy blackouts a few years back out there? Well, they may not have them anynore but the good bunny huggers of the state are paying for the "not in my backyard" attitude and lifestyle through their collective wallets. I have a friend who lives in Frezno. Today he told me that I would be shocked if I ever saw his electric bills and then he admitted that his last one was in the $600 range and that he has had one over $1,000 this summer, and that was with his thermostat set on 78 !! Shocked Shocked Shocked All because of the well intentioned but totally near sighted and ridiculous liberal view that they want to keep there state "green". What a farce, much of the state is a natural BURN ZONE!!!! Now we have Nancy Pelosi [ULTRA liberal, socialist San Fransiscan] as the speaker of the house and she adjourned the house for a 5 week summer recess without allowing a vote on drilling because she KNEW that enough political persuasion that shall not be mentioned had jumped ship to PASS that vote!!! California was also where the ban on offshore drilling started because of outdated practices and carelessness that lead to some oil spills. Any rational person that has done their homework knows that offshore rigs not only add to our oil supply but also add DRAMATICALLY to the flora and fauna in that area of ocean AND the local economy because of the oil AND the fishing opportunities!

Wake up folks! I LOVE nature and all that's in it but 99.99% of all the living things that have ever existed on this planet have gone extinct for one reason or another, mostly because they couldn't adapt to change. If a few birds, snails, clams or whatever get killed that's regrettable but they will either adapt to the new danger of wind turbines [or whatever else that comes along] or go the way of the Dodo Bird!!! There ain't no free lunch!

The blackouts seen last year were a result of a wind out event in west Texas & New Mexico. Wind energy requires a backup, the more wind energy you've got, the more backup you need to sustain the same amount of energy production, at much higher final cost to everyone.

I don't know how to explain this to people, but to me the view on the Laguna Madre, Baffin Bay, and the Kenedy Sand Prairie is worth so much more than a few $ on my electric bill, John Cowan or John Dearman's paintings would lose part of their magic with a wind turbine in the background. It's not about birds in the end, its about the something far less tangible, something you either get or don't.

I can understand the asthetic issues that are bien brought on, it does make sense.

I am invovled in the oil and gas business sector and in my company we are seeing a great push toward alternative energy. The amount of funds invested in wind is simply amazing. If you do some research, you will see that the wind will be invading all areas that have a constant wind flow with a vengance. Even though they do take away from the nature side, they are a sight to behold when you are around a field full of these. Solar will also be used substantially and we will be seeing panels all around. we have just opened the alternative energy division in our company and we are looking to double our business just with solar and wind alone, making our oil and gas business look small in comparison. If you go to the CC port, you will see the vast amount of blades and turbines getting prepped for install. Will be interesting how it all plays out, especially with CC being known as the windiest city in the US.
