Are there any Texas Constitutional Lawyers out there?
I am not a lawyer, but the mayor may not be aware of a Texas State Constitutional Ammendment passed in 2015:
The amendment added a Section 34 to Article 1 of the Texas Constitution. The following text was added:
Sec. 34.
(a) The people have the right to hunt, fish, and harvest wildlife, including by the use of traditional methods, subject to laws or regulations to conserve and manage wildlife and preserve the future of hunting and fishing.
(b) Hunting and fishing are preferred methods of managing and controlling wildlife.
(c) This section does not affect any provision of law relating to trespass, property rights, or eminent domain.
(d) This section does not affect the power of the legislature to authorize a municipality to regulate the discharge of a weapon in a populated area in the interest of public safety.
Gov. Greg Abbott said:
Proposition 6 protects your rights as a Texan to hunt and fish. Texans have long lived off the bounty of the land. Hunting and fishing are family traditions, and we know how to conserve our natural resources for future generations.
Supporters of the measure, including the NRA, acknowledged that no one had tried to curb the right to hunt and fish in Texas. Instead, they justified the amendment as a safeguard against future threats by anti-hunting groups. |

I never thought I would see the day fishermen or women for this matter would be so aggressively discriminated against in the State of Texas.
It's sometimes surprising what some people will do when given a little power, as the result of being promoted beyond their capacity to think rationally.

Read the 'Order' and it's almost worth the citation just to fight this nonsense.
Fishing from the shore -- whether it's from the ship channel, jetties or the beach -- will be prohibited.
Walk out to the first bar and start chunking lures. Sorry Officer, but I'm not fishing from the shore.  |

Exactly! I spent my life enforcing the law, some I agreed with and some I didn't but I did my job. I would have hung my stuff up before I'd write somebody for that nonsense! Absolutely ridiculous!
A lot of this these lockdowns and stuff are just fluff for the politicians and their sheep and wont be enforced as I hope this is. This is the stupidest most overreaching that I've heard of though! |

The bay is still open. You know the next adder will be the piers. Will have to change the rules on them, instead of three rod limit there will be a one yoga mat limit. |

Nueces County Judge Canales' order is reasonable. PA's "Third Mayoral Decree" is ridiculous. Well-intended, but not very well thought out. Glad I live in Aransas County!

Funny how we all rush to judgement. This is not a vacation. It's going to get worse before it gets better. The more people travel around the more the virus will spread. Would you like people your not sure of to come hang out in your backyard? The two confirmed cases here in Port A had traveled. Isolate and conquer. That's strictly my opinion. With that logic, ban ALL activities on the beach. Dont allow runners, yoga-ers, walkers. Ya see, those residents and travelers are allowed. Just not fishing. No resident fishermen/women? All the folks fishing are travellers? |

Not a rush to judgement Capt., merely an application of good old fashioned common sense.
How much more isolated could one be, fishing solo at the end of the jetty, or on a deserted section of beach? Two joggers passing on the beach is OK, but a jogger passing me while I have a line out isn't? |

Everyone does have their opinions. I'm just curious about yours. Is it okay for you or other locals to go out and fish?
For the record I went the other way today and am sitting on a private pier catching lake livingston blue cats. Very nice morning! |
