Just thought I would share with you facts about Sharkathon Oct 13th:
1) All this nonsense about polygraphs - - polygraph is not legal evidence in a Texas court, not acceptable at all.
2) They boast 3rd degree felony for cheating on their fishing tournament ? Oh yeah, I'd be first in line to defend anyone they try that BS with.
They maybe ripe for a class action suit if enough entrants been wronged, dumping discovery on them could uncover a lot.
The conflicting rules have gotten so extreme for this tourney that many folks I talked to have backed away. |

| Don't enter then. You agree to the rules when u enter the tournament. Go get all those volunteers that give their time for free to make the tournament happen. Then they have to put up with stuff like this. Thanks to all the volunteers that put on sharkathon as they work their butts off for nothing. |

Tournament Fraud
It is illegal to enter fish in a saltwater or freshwater fishing tournament that have had the length or weight altered, were taken unlawfully, or are fraudulently misrepresented.
[While the state's Parks and Wildlife code already had a statute regarding freshwater competitions, it was not until last year that the Legislature added saltwater tournaments].
Violation of the law, a first-degree misdemeanor, becomes a third-degree felony when the tournament's purse is more than $10,000.
So yea, it can be elevated to a 3rd degree felony. |

hmm....sounds like one of your "Team" mates has been DQ'd in the past and you're still sore about it...wouldn't take many of us on here very many guesses as to which "Team" mate you're talking about...
if you are moaning about not being able to "safely cheat", then please do as others have mentioned and just don't enter....go resurrect the Surf Cats or start your own Cheaters Tournament....sounds like you need to cheat to win...
when you sign the waiver, you agree to all the rules...and what's rule number one?

if you're so sure of yourself, the statute of limitations is still wide open for your "Team" mate that got DQ'd last time....what are you waiting for?

I've been lawyering now for 28 years, and while I agree polygraphs are inadmissible, that isn't really the point. If you agree to be subjected to one as part of the tournament entry agreement, then refuse, you're disqualified. If there is evidence, other than a polygraph, or your refusal to take a polygraph, that you attempted to defraud the tournament, that's an entirely different issue.
If you want to play someones game, you have to follow their rules. And stealing is stealing, whatever the context. And I like to say I don't hate anyone, but I come damn close to hating thieves. |

Yeah its BS they wont let you cheat, it's a real shame when cheaters back away from a tournament. No doubt everyone that enters will be really upset there's less cheaters this year. |

As a person who fishes many large inshore tournaments, with 5 figure payouts, you go by the rules or your out! Period!
Now, failing a polygraph is NOT grounds for a felony fraud charge due to the FACT that polygraphs are not admissible in court. That charge would require other strong evidence. Examples being cut tails on fish, weighted fish, manipulating the fish in a very clear way and it has to be over $5,000 I believe.
Getting kicked out for failing a polygraph is part of the tournaments rules, not state laws.
Do I believe in polygraphs? ABSOLUTELY NOT! I have seen people with my own eyes cheat in the API tournament and have witness'es. Told director,
person was polygraphed and passed and won stringer pot over $4500. I was mad as hell! Not reliable, but not any other option IMO |
