Just a heads up I was fishing brown and root flats area friday afternoon when I happened to look back and see a green chevy Z71 pulled up right behind my truck. I was on the otherside of some mangroves so he couldn't see me. I start heading back to the truck when i hear pop pop. I now start jogging though a bunch of mangroves draging my net, stinger of fish, tackle, and rod geting caught on everything, and i see the guy with what looks like a small rifle fire off 3 more shots not at me or my truck just kind off in the air. I start to get through the mangroves, at which point i relize I am jogging towards a guy with a gun, when I guess he sees me. He gets back in his truck and sits there as i keep getting closer and then slowly drives away. I guess he was firing some shots to see if anyone was around before he broke in my truck? I got back and nothing was broken into or taken. I think he picked up the shell casings because i did not find any. Thought ya'll might want to be on the look out and be careful out there.

its a felony to fire a firearm into the air with out a solid target.. people have died from the rounds reaching terminal velocity on the way down

sounds like the cops should here about this

glad you are safe, bet that was pretty scary..
were you armed? i wouldn't have gone towards that without a weapon
was there anyway you or your car were on private property?

No, not a felony. Call the cops though, give them a description of the truck.

Surely a felony IF the bullet hits someone on the way back down. Not sure if it would be if it were to hit property and damage it.

"In Texas, random gunfire is a Class A misdemeanor, punishable by a maximum one year in jail and $4,000 fine. Anyone who injures or kills someone with a stray bullet could face more serious felony charges."

seems yall are correct...
it is a felony to discharge a firearm randomly into the air in most states though..

returning bullets are easily capable of killing a human being. Firing a weapon into the air at random demonstrates an intense disregard for human life. Either that, or an incredible ignorance of the function performed by the gun being shot.

Or, its just a dude trying out his new air rifle or 22.. Trying to find a desolate place to shoot it, not knowing a fisherman was walking back to his truck.. But, your right.. Call the cops.. Its a terrorist felon, trying to relieve the world of its carrying capacity..

My cousin was actually shot this way by a 22 during a new years celebration. Thought someone threw a rock at him till he saw the blood. The bullet lodged so close to his heart the doctors wouldnt take it out till years later. Call the cops on those idiots please.

You internet lawyers ever hear of duck season? You are not in other states, you are in Texas. Not a felony.

Also, don't use Wiki as a source for legal information.

shooting a shotgun at a duck is allot diffident than firing your .40 call into the air randomly..(that shotgun load is not going to go very far)i wasn't saying you would get in trouble for blasting a coon in a tree at a ranch...but shooting in the air in city limits will get you arrested

Just stop.

There are not an average 4 murders a day in SA, It's not a felony to shoot in the air and whatever else you make up out of the fog is going to be wrong too.

okay whatever you say buddy

there are an average of 4shootings a night in SA, go talk to the police chief(i did, did you?)
it is illegal to shoot randomly into the air in all states in city limits (it is a felony where i lived before here), try it across from the local police station and see what happens Smile
(i have a friend who was hit with a "random" 22lr in the head hunting in the woods, i have first hand experience with this!, whereas you are just talking out you @ss)
ever held you friends brains inside their head?

some advice, keep your comments to yourself when looking for a fight online it only makes you look arrogant..
