Jack has been working on an extensive response to the EA since February based on the EA issues that the Park previously represented to us that they would be raising. It was represented that two EA issues would be involved, one on the speed limit during turtle nesting season and the second (which CAC advocated) whether the speed limit should be reduced to 15 mph within close proximity (say 100 yards) of parked cars, visitors, etc. The current Park release on the EA makes no mention of addressing the second issue, which we believe reflects their bias against fairly addressing the 25 mph speed limit issue.
Also, we have previously prepared a Power Point presentation that the City of Corpus Christi requested on the proposed EA and its potential adverse economic impact on the region that was presented in Washington in May.
We have also formally requested that the EA address the number of turtles which can be “taken” at the Park without endangering the worldwide turtle recovery effort. Since correctly addressing the “taking” issue would clearly indicate that no reduction of the speed limit was indicated, the National Park Service has elected not to do so and instead has totally changed the scope and extent of the EA to obfuscate the weakness of their position that the speed limit should be reduced to protect the statistically insignificant number of turtles nesting at the Park.
The Park previously represented that an impartial firm, rather than a representative from the National Park Service, would do the scoping on the EA. If that is the case, then CAC believes that it will be able to make persuasive arguments that the speed limit should not be reduced. If a representative of the NPS makes the determination, then we recognize that it is unlikely that our arguments will be fairly considered and that a fair result will only be secured through litigation, which will require the building of a litigation fund.
CAC will publish its response to the EA once it is filed and will keep you posted on new developments.
