Judge orders beach open to public by Tuesday

The beach that has been closed to traffic for Packery Channel construction will be open by Tuesday, city officials promised a district judge today.
Tom Utter, special assistant to the city manager, appeared before District Judge Sandra Watts in an informal hearing after lawyer Mike Hummell filed suit for the beach to be open to vehicles. Hummell claimed construction was complete and the city was keeping traffic off the beach so voters wouldn't see it before a Nov. 7 vote that would permanently ban vehicles in order to attract a $1.5 billion resort.
City officials have said for months the beach would be open to traffic when construction was complete, which they hoped was by Friday's Packery Channel dedication date. Officials have previously stopped short of setting a deadline for the beach to be re-opened to cars but said it would be before the election.
Utter told Watts the construction work that continues, including sand removal from the seawall and a handicapped ramp from a new parking lot on top of the seawall, would be finished on or before Tuesday so the beach could be open. _________________ The Trash Heap Has Spoken!

Great. How are they doing on getting the ballot language changed  _________________ Fishing and Kayaking its a rough life but somebody has to do it. |

Great news. Now that the city has removed all the sand along the seawall and made the beach 4x4 ready. Hope we have a couple of high tides to pack down the sand. Wonder how much it cost city to move sand and why did they do it. _________________ paulj4400 |

Are they waiving the beach parking permits for that exact area? If not how many will be issued at the north jetty ceremony friday for illegal beach parking?.... Plan calls for parking in area. IF ticketed doubt would hold up in court...entrapment laws........whats this attorneys # that filed the suit? _________________ -STAY THIRSTY MY FRIENDS!- |

So is the Beach now open or did they come up with another excuse to keep it closed???
I'm planning on coming down in the morning after I get off work for the BAC benefit, but I haven't seen anything in the past couple of days confirming the opening or whether the benefit/celebration is still on for tomorrow. Any info would be appreciated.

There were people out at the South end of the seawall today selling beach parking permits. Also the construction sign was removed and a one way sign installed. traffic will be south bound in front of seawall. on the north end of seawall there was a berm to stop traffic. They were still removing sand from the wall. _________________ paulj4400 |

If I'm not mistaken that is weel South ot the Jetty. Can the Beach be accessed near the Jetty as we were asked to do for the benefit? or are they only allowing access from the Seawall to Padre-Bali park?? |

Drove through the open gate at the St. Bartholomew access road north of the seawall just before the ribbon cutting took place to officially open Packery Channel. The route had been recently groomed, so the beach road to the south jetty was firm, but the tides had come up enough that for a little stretch at the access road/beach road intersection you had to drive briefly in the water. Plenty of space to park at the south jetty, and many were parking.
The only snag for the "Funraiser" may be the red tide. I'm still coughing from the dose I got at the jetties and down at the south end of the seawall while checking conditions. It was worst at the south end of the seawall. _________________ The Trash Heap Has Spoken!
