It is about both mauler. Jumping in a blind you didn't build is not illegal, I know that. But that doesn't make it right. Trashing a blind is worse. I have seen guys go to a blind I helped build well after shooting light and hunt. We made the comment "at least they did it right". I know it's public water. And my statement about building blinds was a little more intended to have people understand how much time and effort goes into building one. Some of these guys make a living out of their blinds and others might want to take their daughters.
I hope everyone can understand that I am just expressing my opinion. I do not believe that I am better than anyone else or smarter.

I am done here. I hope everyone can understand that I am just expressing my opinion. I do not believe that I am better than anyone else or smarter.

"Jumping in a blind" is not illegal. Harassing someone in a blind while they are hunting is.

I don't understand....What makes it not right? Because you said so? Its public property!!! This is Texas! This is America!

Say you decide to build an artificial reef by throwing some debris out offshore or something, on public water-Do you expect that to be your private fishing hole too? What if I happen to notice the structure and fish it? Are you gonna say that's wrong and chase me off?

Here is the key: I don't understand who thinks that one patch of public water is theirs because they put a blind on it.

And don't lump trashing blinds and hunting from them in the same group. Two different animals there.

Sorry, I have hunted in other states where people think public land is their own private ranch and dealt with that attitude before. No offense taken from you, but it is not "right" to tell someone they are doing wrong when its only your opinion. We all have opinions, and the law is the law.

I would bet that blind jumping and trashing one does go hand in hand... The blind jumpers didn't build it so why would they think they would need to take care of it.. They can just jump into another one down the pond... I don't duck hunt so thats just my .02....

Mike,

No offense, but that is a losing bet.

Although I very seldom duck hunt, I know many who duck hunt from public blinds, and they (read 100% of them) most certainly do not trash or tear up the blinds.

I am sure there are bad apples, but there are bad apples everywhere.

You simply can't lump trashing blinds and hunting from them together, any more than you can link fishing and trashing the water together.

No offense taken MM.. It only makes sense that the hunters trashing blinds are blind jumpers because the guys that built the blinds are not going to trash them... Yeap, there are bad apples every where and they give everyone else a bad name.. I hope I don't miss-speek hear but I don't remember anyone saying that all blind jumpers trash blinds.. Thats just my opinion so this will be one of those topics we will have to agree we disagree...

IMO If you are hunting a blind you know you didnt build and you turn away a man with his young daughter you are the ultimate POTLICKER- end of story.

We had a potlicker post up 150 yards from us in Shamrock bc he had seen us killing quite a few birds on a particular spot on several previous hunts. We asked him why he was so close- he replied "I am not that close and wont be here too long". So we proceeded to pass shoot any birds that were in the general vacinity! That guy is a SUPER POTLICKER!!! We dont even have blinds that we hunt anymore.

You cant claim public toilets so why try to claim blinds on public places. If you want to hunt somewhere you had better be sure you're there early enough to make sure you get your spot. I went to Nighthawk on Thursday was running late and there were already some guys setting up in my blind. I hunted another spot and had a successful hunt. No big deal. Don't get mad go somewhere else.

"So we proceeded to pass shoot any birds that were in the general vicinity!"

This is one of the more stupid posts on this thread. Sky blasting birds is irresponsible, immature, and not to mention all the birds you potentially wounded! They didn't break any laws, and you possibly were (harassing wildlife) who's going to get ticketed? Some of yall have some serious issues with ducks. I'm not that mad at them where I try an kill anything flying if my panties get in a wad. Come on Jan 25... Jason Slocum

Newsflash- It isnt illegal to pass shoot birds.

Secondly- Since that hunter felt compelled to ruin our hunt why not do something in return? The birds that were too far were just shot at to flair them. Our spots come from many hours scouting and hunts that may not be so good. We dont rely on other hunters spots and listening to other hunters. This clown was hunting almost 2 miles away from us on several hunts- which is fine- Then after hearing lots of shooting from our area (no blind) he ran his boat down in front of us and past our spot by several hundred yards, turned around a went the same way he came from. Cut his boat off picked his crew up and took off again. Where I am sure he said "I know where they are hunting now".

5 days later we were hunting our same spot and were set up plenty early in our portable blinds and ready to go 15 minutes prior to shooting time. Right at shooting time we see the same boat run past our spot (just outside our decoys by the way) and set up in an area 150 yds up the shoreline from us. Then we had our conversation mentioned above and it played out as previously stated. Is there not something wrong with the other hunters tactic? IMO that is as bad as it gets!!!

Since your not an avid duck hunter let me inform you of the law they broke- DUCK HUNTERS CODE OF ETHICS LAW- That is the law that was broken-

And don't lecture me on conservation please- I am an avid conservationist and a longtime supporter of DU and Delta Waterfowl through volunteering (DU) and financial donations (DU and Delta). We were teaching a potlicking scumbag a lesson he needed to be taught. I realize this is public land- but there is plenty of room for all of us. Scout your own ducks and dont set up next to someone that is already there, and definately not within "peppering" range.

Thats all folks! Cool

You are discussing something different than "blind jumping"

Also, it may not be illegal to "pass shoot" birds, but it is illegal to interfere with another person who is lawfully hunting or fishing.

By the way, hombre, the following statements are a confession and an admission of guilt under Texas 62.0125 c-e! And pretty disgraceful as well.

You can 'think' it is a grey area all you want, but the law is the law. and section c specifically mentions 'intent', which you have definitely confessed to in this thread, and it doesn't sound like the guy you speak of was intentionally trying to interfere with your hunt.

Hell, he could have an entirely different story altogether from his point of view...How do you know that wasn't 'his' spot before you or when you weren't out there?.....We all need to get along and not be so darn protective over "our" spots if someone is already there first, and chill out a little bit.

If you build a blind, it is public. You know that when you build it. It is the law. Its public property. That's what Texans don't understand in our land of private ranches. Try hunting deer in another state where most of the land is public. You can hunt damn near whereever you want, but so can EVERYONE else. Kinda like our water.
You would like to see everyone build their own!----ha....can you imagine what that would look like!

Is this really about someone using a blind, or someone trashing yours? Using and trashing are two totally separate things!

try hunting someone elses treestand on public property...

The law was put in place to avoid some jerk from building 10 blinds in an area and effectively shutting out any other hunters. So now people think that makes it okay to hunt any blind Rolling Eyes It is nothing like an island, if someone puts hard work and money into putting a blind in a spot and you haven't, don't hunt it, an island is naturally there a blind is not.
If there was no "Duck hunter code" there would be people spending the night in the best blinds so they could be there first.
