There is a park ranger that I do miss seeing. He was an older man driving an old Bronco. He used to stop and talk to my family and I all the time. Nothing official, just friendly conversation. I supposed he retired because I haven't seen him in 5 years or so. |

Sorry, but you're wrong, he doesn't need probable cause to ASK you to sniff the drink. He needs probable cause to make demands. If you say no and he pulls you out of the car and grabs the drink and sniffs it then he needs probable cause. But seriously, who drinks soda out of a glass in a vehicle anyway? Not knocking it, but if I were an LEO that would raise an eyebrow for me as well.
Sorry back... He does need cause... If she had denied him do you really think he would have just said okay and walked away??? Noooo.... He would have caused a scene in from of my kids and yanked us all out of the truck. Being smart but against my beliefs, my wife agreed to THE SEARCH. AND....my wife drinks soda out of a glass tumbler that's who! BECAUSE we have cases of soda at home that are hot and she puts ice in her glass. Is that so unusual?
The probable cause shouldn't be a glass of soda, it should be red eyes, slurred speaking, the smell of alcohol on her breath.

But you absolutely have to have probably cause to make the stop in the first place and one license plate light bulb out does not get you there. Judge would throw out all results of that ridiculous excuse of a stop in a heartbeat!! You obviously don't understand the probable cause issue at all and missed the real probable cause issue completely. Once you make a stop without probable cause every thing you do after that is "fruit of the poison tree".
Oh yeah justletmein - the following is not directed at you.

If you would get those jerks of yours under control your sensitive feelings wouldn't get hurt because people would not be calling them names. They totally deserve the names they are being called. It's OK, such is the case the guy wasn't guilty so nothing happened. Had she been drunk they would spend multiple thousands defending and a drunk would have been removed from the road that night. Almost doesn't matter if the charges stick or not, getting off on the charges as opposed to not making the stop and allowing the drunk to roam the highways is an acceptable exchange. edit: The drunk also may not fight it in court and try to settle. I also fully understand probable cause, the guy said the officer needed probable cause to ask his wife to sniff the drink which is not the case so I was just rebutting that. All I'm trying to say is, don't complain about the cops when they see you driving down the road with a beer in your hand and decide to pull you over to check you out.

I've been traveling that beach for a few years at this point and have never been stopped. We have had the patrol stop at our camp a few times however. One time they stopped and asked why I cast so far out for Pomps when they are running between the first and second bar. I felt shame.
However, more seriously, the idiots running the beach at night doing at least 50+mph hasn't stopped. It is only a matter of time before an entire camp of kids is run completely over. Only a matter of time.
I respect the law enforcement highly and if they feel the need to pull us over I won't have a problem with it. I won't have a open container nor will I be driving if I have been drinking so I pretty much have nothing to worry about. At the same time I don't like abuse. It's a fine line down there with all the illegal stuff that goes on behind the scenes. If you are going to run with a open container in your vehicle then props to the police for pulling you over. Hello???? Open container? They have laws about that? I'm pretty sure I read that somewhere. _________________

Probably going to jinx myself but I haven't had any bad experiences with the rangers yet. I live on the island and go to PINS a couple of times a week and the few contacts Ive had with the rangers have been professional. I never take a drop of alcohol down there though and maybe that has something to do with it. A recurring theme in these stories appears to be alcohol.
I don't condone harassment but I can almost understand how they could become jaded...seriously think about how many drunks/jackassess there are in this area...it's literally out of control. |

Negative. Understaffing is not an issue. If it were, they would focus on the alleged rampant crime occurring down island and not on beach fishermen. The fact is there are too many of them and not enough to do. _________________ "Ya'll must eat a lot of fish" |

I know and understand they have a tough job to do but I also know that none of these harassment type stories occurred until about 2007. That's when you had rangers following people ( me included around the boat ramp ) appearing to wait for you to screw up or go over the speed limit by a mile or two so they could stop you. They also started pulling people over to ask them how their experience or time was on the beach and then asked if they had any concealed weapons. That's just not right. Oh and coming to check fishing licenses with their hands on their firearms. It's as if the public "their customers" are guilty of something.
Ticket speeders and folks drinking and driving but please don't just fish for reasons to search vehicles - your license plate light is out or your blinker is not working. Pull them over and tell them but don't cite them.
I don't think that is too much to ask. |
