What was the outcome of the call to the lawyer? Probably makes more sense to take their advice than to rely on the "Holiday Inn Express" judgements that get rendered online?

Just wondering.

My Lawyer is also a good friend andlet's just say, he had an interesting response!

Just wanted to say the I welcome all the response and sadly now realize this wasn't just an isolated case. You have a true Gem in this park and I truly feel for the law abiding guys that have to use it everyday!
But thru all the responses, one poster caught my eye, and I'm sure it's pure coincidence but it could've come from one of the guys I talked to, he just used a "term" in his post that only me and that guy used in our conversation. lol
Okay now I have to watch my words in this but this is "my" perception from my two conversations; the 1st was to the Park Super, he seemed genuinely concerned and was very polite, he listened to what I had to say and passed it along to the Ranger. the 2nd was a call I received from 'I believe" the Ranger's super., I appreciate his promptness in returning the call but I wish he would've watched the video before contacting me. now let's just say we agreed to disagree! He was polite enough but seemed confused by why I posted. One thing I noticed was my perception of his perception of me was that I was being overly dramatic in my post and that were his words! Some of the things I learned from it was: 1)There are 2 different kinds of "Park Rangers", one that leads beach walks, take your money , shakes hands and does wildflower tours. and the other that patrols the park and keeps the peace. 2) The Rangers are under staffed and have a difficult job to do with drug trafficking, smuggling and illegal hunting, etc....3)Does not like his Officers being called names, which I understand and sincerely apologize for. 4)Even though he wouldn't admit it, He stands behind his Officers and I understand that is his job, you have to trust the people that work for you. His exact words were and I quote "if my Officer said you crossed the double yellow stripe, then you crossed the double yellow stripe". 5) Does not like the word "profiling" even though He stated and again I quote " I have learned throughout all my years of experience/training, if the suspect makes a sudden turn or stop, then they are usually up to no good". and lastly I didn't know that they will not let you look at the video! He did have one question for me and I didn't really have an answer for it but after sleeping on it I do now. His question was: If Corpus PD or DPS did this to me, would I react the same? My answer would be "no" and the reason is because you don't see PD, SO or the DPS sitting outside of bars/clubs waiting on people to leave!
What I have come to realize from all this is that It was my fault, I fit the "oops" I mean, I displayed a beer, I made a sudden stop/turn at the bathroom to take a phone call and lastly I allegedly weaved across the yellow stripe. Peace Out....

not at all Fin-addict, thanks for coming back on and clarifying a few things....you do the crime, you do the time is basically what occurred....

however, I think there's more to the story than that, as you alluded to with the behavior difference between CCPD, DPS, and our Enforcement Rangers, which many of us have noticed, whether the "hard way" or not....many of us not by infracting any rules, but "just being there".....

and no one from the Park seems to be in any hurry to offer any vindication or explanation in any means I've seen....

pretty simple....

Let's just say that the general consensus appears to be that these yahoos who are supposedly "keeping the peace" at PINS are not respected by normal folks because they abuse their power. it's all well and good that you had an open container (not smart), but the fact is that you were pulled over after they had followed you around for 15+ minutes! I don't mind having a park ranger roll up on camp and check a fishing license if he/she is POLITE and not a cheese ball. When they are "checking a camp," the campers are not guilty because they are camping, which is what it always feels like. Likewise, when they are suspicious of behavior, it does not mean they get to check their manners at the door, especially when you have so many instances where FAMILIES with young kids get harassed for what just seems like the hell of it. I acknowledge they do not have an easy job, but if your response to difficult work is to be a bean pole at all times, maybe you should pick a different line of work. I do not live on the island. For me to visit costs me $500 in gas round trip. I bring my kids (5 of them), my trailer, and enough gear to fish an army. What I do not deserve for my effort to make their job even REMOTELY relevant, is an interrogation. Particularly when I clearly look like Chevy Chase on a National Lampoon's trip. I mean, come on. Anyway, as I read this post throughout the day and see the multiple replies, one thing is clear: there is a real issue here, and it's not just a bunch of people with minor complaints. It's actually the folks who CARE about that island and love it for what it is. Im aggravated. Evil or Very Mad

Dang this thread took off. Shocked

Let me preface this to get something straight here. I don't support abuse of power, intimidation, rudeness, or searching without cause. But if you're intimidated just by LEO presence and running radar and checking for DUI you may want to ask yourself why that intimidates you.

chazthefisherman wrote:
sorry but he does need probable cause and it is considered a search. My wife showed no signs of drinking and certainly no signs of being drunk. He could clearly see that it was soda in the glass. He was fishing.

Sorry, but you're wrong, he doesn't need probable cause to ASK you to sniff the drink. He needs probable cause to make demands. If you say no and he pulls you out of the car and grabs the drink and sniffs it then he needs probable cause. But seriously, who drinks soda out of a glass in a vehicle anyway? Not knocking it, but if I were an LEO that would raise an eyebrow for me as well.

[Obviously quite a few people care, hence the posts in this thread. This attitude of "well I have rights, but who cares if they step on them a little" is precipitating this type of behavior from our LEOs in the park. If I do not consent to an unlawful search, it does not equal an admission of guilt. Some of us just don't think it's any of their business.

Care to point out where I said an unlawful search is ok? I bet you can't. Wink

Quick stop to check for drunks is standard practice for LEO, it's the only way they can sift through and make an attempt to find a few drunks. If it wasn't for that they would only be responding to head on collissions on PR22 and 4x4's parked on top of somebody's tent on the beach. I don't mind a BS excuse and being pulled over for a few questions and sent on my way, that's not illegal search and that's not a violation of anybody's rights. Anyone who's bothered by something like that likely has something to hide in which case I could care less if it ticks them off because they're the exact people who need to be checked out anyway.

Trust me they will ask as many questions in the nicest ways and you may sometimes feel compelled to oblige to their request but don't.

If you consent to a sniff of a drink but not to a check of a bag .. Guess what's that's suspicious and could warrant probable cause - so just say no!

I gotta admit though, I wouldn't mind being searched by the lil blonde....she's hot!!!

As far as crossing the yellow line....I would love to see anyone of the rangers drive my suburban and NOT cross the yellow line, she kinda goes where she wants!

I have been on the "abuse of power" side as well. I was pulled over for crossing the center stripe as well. Now whether I did or not I dunno, maybe? But I was asked if I had been drinking too which I replied yes one beer 4 hours earlier. I was asked to step out of the vehicle and he gave me a field sobriety test which I passed with flying colors because I wasn't drunk. All of this I understand if I hit the stripe or crossed it or whatever. What I don't understand is why he then proceeded to search my buddy that had pulled up in front of me for no apparent reason. Totally uncalled for.

On the flip side I have had some rangers stop by camp and shoot the breeze about fishing and weather (probably really checking out my super hot bikini clad wife Very Happy ) and really were pleasant to have a conversation with. Actually he stopped twice to get an updated fishing report for when his shift ended lol.

If anything this thread should be a wake up call as to what rights we do have and when they are being violated. And I agree something needs to be done out there but it won't stop me from going to the beach that I dearly love.

I'll turn you in for wearing a lude pink thong, we'll see how quick you can get rid of that! Laughing

We need pics of the hot blonde, for research purposes of course.

Nope! The pink thong is edible, my passenger isn't going to be real happy though. Shocked

If the road was smoother, I wouldn't have to risk a ticket by hugging the center line. I'm sure I touched the line trying to avoid the gopher damage at roads edge. Jeeps are also known to wander a bit in the wind.

There is a park ranger that I do miss seeing. He was an older man driving an old Bronco. He used to stop and talk to my family and I all the time. Nothing official, just friendly conversation. I supposed he retired because I haven't seen him in 5 years or so.

" For me to visit costs me $500 in gas round trip. I bring my kids (5 of them), my trailer, and enough gear to fish an army."

One day the city fathers and county commissioners are going to wake up and realize that the arrogant LEO's (not all thank goodness, but enough) are driving the out of town fishermen/tourists away. When I come down, if I bring my wife she stays in town and crushes the bank account by shopping. In this day and age with things like Obozocare and a crappy economy staring many in the face, the place that is cut back is not clothes for the kiddies, not food on the table, but rather high cost excursions to places like Corpus, Rockport, etc. A typical long weekend fishing in Corpus costs me excess of a $1000, by the time all the things are purchased. Each month I don't come costs your city. Ask your city father if his budget could stand a decrease of say 15% due to decreased tourism. The clowns (again not all, but enough of them) over on PINS are driving $$$ out of your city. They are paid by the FEDS and probably don't give a rats behind that the city will suffer. Just wait to see how much tourism suffers when Obozocare gets going in January.
